Torq Terms of Service

Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of Torq, a GPS speedometer and driving telemetry app operated by Eversight Studio LLC (“Eversight Studio”, “we”, “us”, or “our”). By using Torq, you agree to these Terms. If you do not agree, do not use Torq.
Torq
Torq provides live speedometer, route recording, trip replay, driving telemetry, scorecard, export, and related app features. Features may depend on your device, iOS version, permissions, sensor availability, GPS quality, network access, and subscription status.
Safety and Responsible Use
Torq is designed for passive recording. Do not interact with your phone while driving. You are solely responsible for safe vehicle operation, obeying traffic laws, road conditions, and proper device placement.
Torq results are informational and for general personal use. Torq is not a certified speed instrument, navigation system, vehicle safety system, insurance rating product, law-enforcement device, or substitute for professional judgment.
Permissions and Data
Some features require location, motion, notification, Live Activity, Picture in Picture, or network permissions. If you deny or disable permissions, some features may be limited or unavailable. Torq data practices are described in the Torq Privacy Policy.
Torq Pro and Subscriptions
Torq may offer paid subscriptions, trials, or other in-app purchases through the Apple App Store. Prices, subscription periods, trial availability, renewal terms, and cancellation instructions are shown in the app and by Apple at the time of purchase.
Subscriptions are billed and managed by Apple. You can manage or cancel subscriptions through your Apple ID settings. Refund requests are handled by Apple according to Apple policies. We may use service providers, including RevenueCat, to verify subscription entitlement status and restore purchases.
Your Content and Exports
You are responsible for the trip records, sensor files, routes, exports, or other content you create, store, share, or transmit using Torq. You should review exported files before sharing them because they may include sensitive location, route, timing, speed, or sensor data.
Acceptable Use
You agree not to:
- Use Torq in a way that violates laws, regulations, or third-party rights
- Use Torq while driving in a way that distracts you or creates unsafe conditions
- Attempt to reverse engineer, disrupt, or misuse Torq or its services
- Use Torq data to make legal, insurance, employment, or safety-critical decisions without independent verification
- Submit false, misleading, harmful, or unlawful information to us or our service providers
Third-Party Services
Torq may rely on third-party services, including Apple, RevenueCat, Firebase, Meta/Facebook, and map data providers. We are not responsible for third-party services, data sources, outages, terms, policies, or content.
Changes and Availability
We may modify, suspend, or discontinue Torq features at any time. We may also update the app to improve performance, security, compatibility, or compliance. Some features may be experimental or may vary by region.
Intellectual Property
Torq, including its software, design, branding, content, and related materials, is owned by Eversight Studio or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership of Torq to you.
Disclaimer of Warranties
Torq is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. We do not guarantee that Torq will be accurate, uninterrupted, error-free, secure, or available for every route, device, vehicle, or region.
Limitation of Liability
To the fullest extent permitted by law, Eversight Studio LLC shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from or related to your use of Torq.
Indemnification
You agree to indemnify and hold harmless Eversight Studio LLC and its officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, and expenses arising from your use of Torq, your violation of these Terms, or your violation of any law or third-party right.
Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the revision date and provide notice as required by applicable law. Your continued use of Torq after changes become effective means you accept the updated Terms.
